5. Copyright Complaints and DMCA Notice and Takedown
VerseDB respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement that are reported to our designated copyright agent.
5.1 Submitting a Copyright Infringement Notice
If you believe that material on VerseDB infringes a copyright you own or control, please send a written notice to our designated agent (contact information below) that includes all of the following:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright
- Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works on a single site)

- Your contact information, including address, telephone number, and email address
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorney's fees, incurred by the alleged infringer or service provider.

Notices of claimed infringement should be directed to our designated agent:
Designated DMCA Agent Reggio Digital LLC (d/b/a VerseDB) 5801 Whisperwood Dr Durham, NC 27713 United States Email: [email protected]
Our designated agent is also registered with the United States Copyright Office. Notices that do not substantially comply with the requirements of 17 U.S.C. § 512(c)(3) may not be effective.
5.3 Counter-Notification
If you believe that material you posted to VerseDB was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. To be effective under 17 U.S.C. § 512(g), the counter-notification must include all of the following:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification

Upon receipt of a valid counter-notification, we may restore the removed material in 10 to 14 business days unless the original complainant first notifies us that they have filed an action seeking a court order restraining the alleged infringer.
5.4 Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), it is our policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Account terminations under this policy will result in forfeiture of any active PRO subscription benefits, removal of user-uploaded media, and may be issued in addition to other remedies available to us under these Terms.

12. Age Restrictions and COPPA Compliance
VerseDB services are intended for users who are 13 years of age or older. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use our service or provide any personal information.
If we learn that we have collected personal information from a child under 13, we will take steps to delete that information and terminate the associated account.
13. Legal Disputes and Arbitration
These Terms and any dispute arising out of or relating to them or your use of our services are governed by the laws of the State of North Carolina, without regard to its conflict of law principles. Subject to the arbitration agreement below, you and VerseDB agree that the exclusive venue for any action not subject to arbitration shall be the state or federal courts located in Durham County, North Carolina, and both parties consent to personal jurisdiction in those courts.
13.1 Arbitration Agreement
You and VerseDB agree that any dispute or claim arising from these Terms or your use of our services will be resolved through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
13.2 Class Action Waiver
ALL CLAIMS AND DISPUTES MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.
13.3 Arbitration Procedures
The arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or, for individual consumer disputes, its Consumer Arbitration Rules). The seat of arbitration shall be Durham, North Carolina, and the arbitration may be conducted in person, by telephone, or based on written submissions at the parties' election. Payment of filing, administration, and arbitrator fees will be governed by the AAA's rules.
13.4 Opt-Out Right
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing [email protected] with your name and clear intention to opt out of the arbitration agreement.
13.5 Changes to Arbitration Agreement
If we make any changes to this arbitration agreement (other than a change to the notice address), you may reject any such change by sending us written notice within 30 days of the change.
14. Termination
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the services will immediately cease.
If you wish to terminate your account, you can do so at any time from your account settings. Account deletion begins a 7-day grace period during which the account is deactivated and recoverable; after the grace period elapses, your account and associated personal data are permanently deleted, your active PRO subscription is canceled with Stripe, and user-uploaded media (profile photo, banner, collection scans) is removed. Public contributions to the comic database (such as edits to series, issues, characters, or other shared records) are retained in an anonymized form because they are part of the community database. For full details, see How to Delete Your VerseDB Account. You may also email [email protected] for assistance.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
15. General Provisions
15.1 Modifications to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms at this URL with a revised "Last updated" date and, where the changes are material, by sending an email to the address associated with your account or displaying a notice within the service. Material changes take effect 30 days after notice is given, except where a shorter period is required to comply with applicable law or to address security or fraud risks. Continued use of VerseDB after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service and may delete your account.
15.2 Severability
If any provision of these Terms is held to be invalid, unenforceable, or unconscionable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions continue in full force and effect.
15.3 Entire Agreement
These Terms, together with our Privacy Policy and any other policies or notices incorporated by reference, constitute the entire agreement between you and VerseDB regarding your use of the service and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral.
15.4 Assignment
You may not assign or transfer these Terms, or any of your rights or obligations under them, without our prior written consent, and any attempted assignment without such consent is void. We may assign these Terms and our rights and obligations under them, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
15.5 Waiver
Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision. Any waiver must be in writing and signed by an authorized representative of VerseDB to be effective.
15.6 Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemic, governmental action, labor disputes, power or internet outages, hosting or cloud provider failures, or other third-party service interruptions.
15.7 Notices
We may provide notices to you by email to the address associated with your account, by posting on the service, or by other reasonable means. Notices to us may be sent to [email protected], or, for matters requiring physical mail, to the address listed for our designated agent in Section 5.2. Notices are effective when sent (for email) or when received (for physical mail).
15.8 No Third-Party Beneficiaries
These Terms are for the benefit of you and VerseDB only, and do not create any rights or remedies in any third party.
15.9 Export Controls and Sanctions
You represent and warrant that you (a) are not located in any country subject to a comprehensive embargo by the United States government, (b) are not listed on any U.S. government list of prohibited or restricted parties (including the U.S. Department of Treasury's Specially Designated Nationals and Blocked Persons List), and (c) will not use VerseDB in violation of any applicable export control or sanctions laws. We reserve the right to deny access to the service to any person or jurisdiction where providing access would violate applicable law.
